Release of Claims and Waiver of Liability

1. This Waiver must be read by you prior to signing.
2. Insurance coverage is the responsibility of each individual participant. .
3. By signing this document you are giving up certain legal rights. It is recommended that you obtain legal advice prior to signing this document.

To: Terry Maynard of Nature Presence c.o.b. Unlimited Worth (Nature Presence)

Definitions: Nature experiences can include time in forests, near lakes and rivers, hiking, backpacking, scrambling, crossing streams while hiking, and nature observation in a variety of weather including storms.

In consideration of Nature Presence accepting my registration I agree to this Release of Claims and Waiver of Liability. I understand that time in nature involve certain dangers, not all of which are listed here. Among the more obvious and frequent are:

1. Inclement and unpredictable weather, which may cause injury due to extremes of heat and cold and which may prevent travel to, from or within an area;
2. Hazards related to travel near lakes or rivers;
3. Submersion in cold water resulting from slips or falling near water;
4. Unfamiliar country, where the participant may become lost, get off the route or be separated from others;
5. Remoteness of location with poor communications and inability to get rescue or medical assistance quickly or easily;
6. Medical problems arising before, during or after the Nature Experience or hiking;
7. Illness related to change of diet or water source;
8. Transport by public or private motor vehicle;
9. Natural hazards, including rock falls, flash floods, steep terrain and the presence of wild animals, exposure to mosquitoes leading to a risk of contracting West Nile Virus;
10. Failure to follow directions.

I further declare that:

I am not relying on any oral or written statements made by Nature Presence or its agents, whether in brochures, advertisements, in individual conversations or otherwise to lead me to become involved in this program on a basis other than my assumption of the risks involved.

I accept all of the risks including the possibility of death, personal injury, property damage and loss resulting from my involvement with the Nature Upliftment I am taking with Nature Presence.

I release Nature Presence, its officers, employees, guides, agents and representatives from any and all liability for any personal injury, death, property damage or loss I may suffer as a result of my participation in their Nature Experience, for any cause whatsoever (including negligence) on the part of Nature Presence, its officers, employees, guides, agents or representatives.

I certify that I am physically capable and fit to participate in this activity and I have no medical conditions or needs other than those disclosed.

I confirm that I am eighteen years of age or older. (Younger participants must have a parent or guardian read and sign this document).

I confirm that I have read over this agreement before signing, that I understand it, and that it will be binding not only on me, but also on my heirs, my next of kin, my executors, administrators and assigns.

I agree that the laws of the Province of Ontario govern this contract and that any legal concerns will be handled in the competent and fair courts in Barrie, Ontario Canada.

I hereby agree to permit Nature Presence to take photographic records of my participation in this Nature Experiences.
